The warranty obligations of BodyJewelry for our products are limited to the terms set forth below. This warranty policy shall only apply to the products that have been purchased from our “website” (https://bodyjewelry.com).
1. HOW LONG THE WARRANTY COVERAGE LASTS?
I. All items and products purchased from our website have a warranty period that the purchaser has opted for. This may range from no warranty at all to the maximum warranty provided on the product’s page.
II. This warranty will remain effective from the date of purchase and covers all manufacturing faults and defects in materials.
2. COVERAGE OF WARRANTY
I. This warranty covers the manufacturing defects for all the products purchased from our website. A manufacturing defect is a deviation from design specifications during production resulting in a product's defect, frailty, or shortcoming.
II. The warranty will also cover the items and products which were damaged due to faulty workmanship.
3. CONDITIONS UNDER WHICH WARRANTY IS NOT COVERED
I. This warranty does not cover chain breakage, loss, or jewelry that has not been cared for (e.g breaks & tarnishing). This means that any damage to a jewelry item due to negligence or abuse, in case if a stone is lost due to bent, damaged, or worn out prongs and other damages of similar nature will not be covered by BodyJewerly. Therefore, if the item was neglected and abused, the warranty will be voided. void.)
II. If due to any reason, the repairs are performed on the item purchased from our website by any person such as a mattel smith, jeweler or any other repairman, we will not be liable for any deviation, detrition or damage resulting from such work and the warranty will become void.
III. The loss of the item will not be covered by any warranty. These sorts of claims come under insurance and as of yet we do not provide any insurance policy.
IV. Without limiting any other exclusion herein, we do not warrant that the item covered hereby, including, without limitation, the technology and materials that were used to make an item will not become obsolete or will remain compatible with any other product or technology with which the product may be used.
4. WHO IS COVERED UNDER THIS WARRANTY?
The original purchaser of this product is covered under this warranty. This warranty is also transferable to subsequent purchasers, transferees, or owners of this product, but the subsequent owner must have the order number and digital invoice to initiate the warranty request.
5. WHAT WILL BODYJEWELRY DO?
BodyJewelry will, at its sole option, provide one of the following solutions to whatever extent it shall deem necessary to satisfy a proper claim under this warranty.
I. Replace the defective product with a direct replacement or with a similar item.
II. In case we no longer have the same product available we will issue a gift certificate of similar value as of the originally purchased product.
III. If we issue a refund on a product for any of the reasons outlined in our refund policy the price of the warranty will not be refunded.
6. HOW TO CLAIM A WARRANTY UNDER THIS POLICY?
I. To obtain a warranty under this warranty policy, you must contact us through email firstname.lastname@example.org or call us at #1-888-242-6166 if you are in the USA or at # 9549332259 in case if you outside of the USA with the order number and email address which was used in the purchasing process of the product.
II. You need to provide us with proof by showing us the videos and/or images of the defective product and explaining to us what is the defect or the problem with the product. You can do so by sending us the images and the videos to our email.
III. We will assess the photographic or video proof of the defective product and based on our observation we’ll do one of the following things.
- If in our opinion if the defect is not a manufacturing defect or it has been caused by any of the conditions listed above in section 2 of the warranty policy, we will reject any request for the warranty claim.
- If it turns out to be a manufacturing defect, we will contact you and tell you to ship the product to us. It will be the customer’s duty to pay the shipping charges.
IV. After confirming that the product is defective we’ll replace it with a similar product and send it to the customer at the company’s charges.
V. If we are out of supply or due to any other reason if we don’t have a similar product in stock, we will substitute the defective product with the gift card of equal value.
7. LIMITATION OF LIABILITY
The maximum liability of our company under this warranty shall not exceed the actual purchase price paid for the product. For the purpose of liability BodyJewelry, its CEO, its staff, affiliates, team and staff members, and any other verified representatives are not responsible for direct, special, incidental, or consequential damages resulting from any breach of warranty or condition, or under any other legal theory. Some countries, districts, or states do not allow the exclusion or limitation of relief, special, incidental, consequential or indirect damages, or the limitation of liability to specified amounts however to the extent of this policy the above limitations or exclusions apply to you whatever the case may be.
8. RELEASE OF CLAIMS
For the purpose of this warranty policy you agree that you fully and completely hold harmless, indemnify and release BodyJewelry’s website, its CEO, staff and team members, employees, shareholders, directors, consultants, affiliates, or anyone else affiliated with us from any and all damages, causes of action, liability, suits, allegations, sums of money, claims and demands whatsoever, in law or equity, that you ever had, now have or will have in the future against us, arising from your participation in or in any way related to our products, using of our products, services, website and/or communications even if we were aware in advance of the possibility of any such claim.
9. GENERAL CONDITIONS
I. This document contains your entire agreement with us in relation to its subject matter. All prior representations (except fraudulent misrepresentations) and agreements are excluded to the extent permitted by law.
II. By purchasing or obtaining our products you are deemed to be bound by all the terms in this warranty policy. This extends to anyone who is claiming or will claim a warranty.
III. The warranty policy is subject to the rules and terms set by BodyJewelry. It can be changed, deleted, or amended at any time without any warning. The final decision for all warranty-related matters rests upon the BodyJewelry.
IV. Our Warranty may only be varied or extended in writing. Any variations must be approved in writing by our Technical Services Department in order to become binding on us.
V. If any term of our Warranty is illegal or unenforceable in any jurisdiction, the legality or enforceability of the remaining terms will not be affected or impaired.
